摘要
陪审团审判是普通法系国家对案件事实进行裁决的一种司法方式,同时也是扩展公民权利的一种政治形式。在梳理历史、分析现实的基础上,勾勒出一幅关于爱尔兰刑事陪审团发展历程的图景,并从制度功能的角度指出,爱尔兰的刑事陪审团在总体上已无法满足由其国情所决定的司法和政治需要。而一个制度要想获得健康发展并产生实效,就必须契合于所在国家的政治、经济、文化和法律状况,否则就会成为仅仅停留在"纸面规则"中的"制度"。
Jury trial is both a judicial approach to case-fact and a political form of extending citizens' rights in countries of common law tradition. By sorting out of historical events and analyzing the current situations,the author,from a perspective of institutional function,points out that the jury trial in Irish criminal procedure generally cannot meet the country's needs in terms of justice and politics,which is determined by Ireland's special circumstances. To attain its healthy development and effective administration,any institution must agree with the political,economic,cultural and legal situations of the country where it intends to take root.
