离婚纠纷中,非法转移、隐藏共同财产的现象经常出现,现行法律制度对受害一方的保护不尽如人意。因此,为保护受害方,可采取举证责任倒置。对转移、隐藏夫妻共同财产且拒不交出的按偷窃罪追究刑事责任。

This paper discusses the illegal transferring and hiding of the shared properties by spouses in divorcing disputes. It is claimed that the existing law is not protective of the victim. In addition, certain approaches are proposed.
