On the Future of China's Securities——Law Protection Problems on Financial Consumers

当今各国证券法制正面临艰难的路径选择,有的国家正从证券法向金融服务法转型,有的国家选择了证券法与金融服务法并存的模式。在证券向金融商品转型、投资者向金融消费者转型以及证券法向金融服务法转型的趋势中,各类金融服务者和金融消费者存在着相同或相似的委托——受托关系,中国应当在兼顾国情和既有金融监管体制的基础上,采用证券法与金融服务法并存的证券法制结构。

Now all countries face a difficuh choice in legal system of securities. In some countries securities law is going towards financial service law, and in other countries securities law and financial service law exist together. In this tendency, securities are going to financial commodities, investors are going to financial consumers, and securities law is going to financial service law. Among financial service organi- zations and financial consumers there exists similar entrusting and being entrusted. China adopts the legal system of securities that securities law and financial service law exist together.
