区域经济一体化进程中“联合立法”的构想

随着生产社会化的发展,区域经济一体化发展趋势日益明显,要求各地方相互配合与协调,拆除区域内各区划间基于传统行政因素所产生的地区分割和行政壁垒,本着经济、效率、互惠、共赢的目标和要求,建立一体化的经济发展空间环境。"联合立法"作为规范区域经济的新的立法形式,为区域经济一体化进程提供规则指引和法律支持。"联合立法"应为刚性法,其效力应当高于其他地方性法规,作为一种新的地方性法规渊源,需要改革中国现行的立法体制。从中国的立法实践和发展脉络来看,这不仅可能,而且可行。

As the social manufacture developing, the intent of district economic integration is clearer. It requires that different districts should not only interact with each other very well but also coordinate with each other excellently while getting rid of the area divisions and administrative barriers caused by all kinds of tradi- tional administrative factors and at last aim at building an economic integration developing environment on the basis of economy developing, efficiency, coporfit, together -win roles. United Legislation - - -as a new legislative criterion area economy, supplies law direction and law support for the area economy integration. United Legislation should be strict and powerful, its power should be over the area laws. United Legislation - - - as a new law originating from the area law, need reform our national present legislation system which is possible and practical in the view of our national legislation practice and development.
