刑法解释若干问题探讨

Issues about Interpretation of Criminal Law

在中国,刑法解释学还是一门幼嫩的学科,刑法解释的许多方面还不成熟,还存在许多争议。检察机关是否应具有刑法的司法解释权?刑法解释的具体方法是否排除扩张解释?客观解释论是否与罪刑法定相冲突?笔者就这三个问题提出了自己的看法。

In China, there are many controversies on interpretation of criminal law. First, should the Supreme People＇ s Procuratorate have the power of judicial interpretation of criminal law？ Second, should extensive interpretation be ruled out the specific methods？ Third ,does the objective interpretation conflict with principle of legality？ The author has his own views on these controversies.
