On the Environmental Rights of Information,Participation and Supervision of Farmers

农民的环境知情权、参与权和监督权是农民环境权所包含的程序性权利,是农民环境权其他权能实现的保证。在探讨了农民知情权、参与权与监督权的定义及相互关系的基础上,总结了农民环境知情权、参与权和监督权在我国推行的障碍主要有:立法缺陷,行政机关定位不准,制度保障缺失,农民环境意识维权意识淡薄。提出完善对策:一是完善立法;二是实现环境行政权和公民环境权的协同;三是建立和完善环境公益诉讼制度和权利补偿机制,以确保农民环境权的实现和救济;最后要提高农民环保参与和监督效率。

Environmental rights of information, participation and supervision of farmers are the procedure right of the environmental right of farmers. It is an assurance of other environmental rights. This paper studies the definition and correlation of environmental rights of information, participation and supervision of farmers, and summarizes the obstacles of their implementation in China. These obstacles are lawmaking blemish, the improper positioning of administration organization, the imperfection of system guarantee and the weak awareness of farmers＇ environment right protection. The paper also puts forward the perfection countermeasures： first, the perfection of lawmaking; second, the coordination of environment administrative power with citizen environmental right; third, the establishment and perfection of environment public welfare litigation system and right compensation mechanism to insure the realization and succor of farmers＇ environmental right; and finally, the exaltation the efficiency of farmer environmental protection in participation and supervision.
