行业协会是由单一行业的竞争者所构成的非营利性组织,在推动区域合作中具有比较功能优势,应该从立法指导思想上尊重社会自身调整、市场自身解决问题的机制,对于行业纪律与惩戒的权威性予以确认,形成行业协会与政府机制的互补关系,行业协调与司法机制的互补、替代与支持关系。

The trade association is a non-beneficial organization consisting of competitors of the same trade, which has the comparative function advantages in impelling regional cooperation. Under the guiding of legislation principles, we should respect the mechanism of social self-adjustment and market＇s self-solution of problems, acknowledge the trade discipline and the disciplinary punishment authority, form the supplementary relations between trade association and government mechanism, and the supplementary, substitution and supporting relations between trade coordination and judicial mechanism.
