经济法的主体结构是经济法规范论的研究基础,本文从利益关系入手,比较公法和私法的历史演进,分析在经济法主体间的权利和权力关系,并以此作为经济法二元结构性的理论基石。通过对经济法主体概念内涵的分析和外延的列举归纳以及相关理论观点的评述,将经济法主体定位于调制主体和调制受体,力求建构一个体现区别性并同时符合法理逻辑和现实需要的经济法主体的二元结构。
