近代中国“相邻关系”中的民事习惯

On Civil Custom of "Neighboring Relation" in Modern China's Real Right

"相邻关系",是指不动产的相邻各方因行使所有权或使用权所发生的权利义务关系。中国传统法制主要侧重于刑法,民事财产类法律规范相当缺乏,大都要依赖民事习惯自我调整。到了近代,随着法制的现代化,情况有所变化,但民事习惯仍对相邻关系发生着重要影响,有些习惯一直延续到今天。对原有的风俗习惯,应取其精华去其糟粕。随着社会发展,相邻关系中还会出现一些新的问题,需要与时俱进,形成新的良善民事习惯,按照有利生产、方便生活、团结互助、公平合理的精神,正确处理相邻关系。

Neighboring relation refers to the rights and obligations concerned in the owning rights and using rights of each neighboring side. Traditionally the Criminal Law was largely accounted with, Civil Law or Real Law ＇ s lacking led to the often-role-playing of civil customs in China. When it came to the modern time, the situation changed a lot due to leg- islative modernization. Nevertheless some of the civil customs remain unchanged till today. As the society moves for- ward,neighboring relation should acquire new and sound civil customs with new issues emerging, so as to keep pace with the aim of building a harmonious society, under the principle of construction-oriented, life convenience, helping each other and fair play, which provides a guideline for the formatoin of new civil customs.
