摘要
准确认识和评价《劳动合同法》事关中国社会的稳定和经济发展的大局。新法确定了倾斜保护劳动者的立法宗旨,目的是实现实质上的公正;无固定期限劳动合同新规则,兼具稳定和灵活的特点,是一项双赢的法律制度;新法对守法企业的用工成本增加有限,主要目的是增加违法企业的用工成本;新法实施的负面影响主要是增加了低技能劳动者就业的困难,同时还应看到产业结构调整和城市化是造成该问题的另外两个原因。本文还就存在的书面劳动合同规定的冲突等不足以及实务中发现的需要明确的问题作了简要分析。最后,提供了着力解决就业和完善社会保障制度等政策性建议。
It is significant for the stability of the economic and social development of China to mad and evaluate Labor Contract Law. The Law is based on the legislative principle of protecting the laborers in order to achieve substantial justice. The Law formulates the new role of the contract without fixed time which is characterized by lightness and stability and a win-win legal system. The Law reinforces the cost of the employment not for the law-abiding enterprises but illegal enterprises. The negative effect of the Law is that it limits the opportunity of the unskilled labor; the difficulty is also due to the urbanization and the adjustment of industrial structure. The problems of the conflicts of written contract and the situations of practice are analyzed in the paper. Some suggestions about solving problems of employment and social security system are proposed at last.
