我国人民代表大会制度的民主理论基础

Democratic Implications of the National People's Congress in China

长期以来,国内外学术界多以人民主权理论来理解我国的根本政治制度即人民代表大会制度,由此得出中国只有本质民主而无程序民主的错误结论。对我国的根本政治制度的研究发现,人民代表大会制度不仅是基于本质民主理论即人民主权理论建立起来的,而且其构成单元和运行过程体现着代表制民主理论和协商民主理论,因而是实质民主与程序民主的统一体。我国人民代表大会制度既有普世性的民主理论内涵,又有中国自己的特色和创造。

The establishment of the National People＇s Congress（NPC）has been watched in view of theory of people＇s sovereignty, which naturally leads to an essential democracy without procedural democracy. This article finds that although the NPC is based on people＇s sovereignty, its components and operation also contain democracy of representation and deliberative democracy. The NPC reflects universal democracy and chinese characteristic as well.
