摘要
《高等学校学生管理规定》确立了高校学生申诉制度,但新《规定》确立的学生权益救济制度还有很多不完善,有的地方甚至与相关的法律存在抵触;申诉委员会必须拥有一批具有法律精神、处于中立地位的专职人员,防止成为"影子委员会";必须适当缩小高校学生申诉制度的范围,建立多样性的学生争议解决机制;要使学生申诉制度在实践中真正有效,根据司法程序的公开、公正原则,需要将申诉过程和申诉结果公开,从而实现真正的高校学生申诉制度的程序公正;申诉制度的某些专门性规定和特殊程序与主流的行政救济制度存在内在冲突,破坏了行政救济制度的完整性和统一性。
The appeal system for college students has been established in Management Regulations for College Students. However, the ensuring system of students'rights is not perfect, and even has conflicts with relevant laws. The appeal council should have its special staff who have law spirit and are in neutral position. It is necessary to narrow the scope of the appeal system for college students and constract solving mechanisms of students'disputes. The publicity of appeal process and results is helpful to realize the effectiveness and the procedural justice of the appeal system for college students in practice. The appeal system's specific regulations, special procedures and conflict with main administrative relief system damage the integrity and unity of the administrative relief system.
