论我国现行协议离婚制度的缺失与完善

On the Defects and Perfection of the Current Divorce by Agreement in China

在我国,由于《婚姻登记条例》在制定时只注重了对离婚登记程序的简化而忽视了相关配套措施的设立,因此在实施过程中出现了被滥用的情况。本文通过对国外协议离婚的介绍、对我国协议离婚立法历程的回顾,在此基础上,分析了我国协议离婚制度的缺失及导致这种缺失的原因,并提出了完善的立法对策。

Since the legislation of Chinese Marriage Registry Act pays attention only to simplify the procedures of the divorce registry and neglects the establishment of the relevant auxiliary measures, this rule is abused sometimes in enforcement. This paper analyzes the defects of the current divorce by agreement rule in China and consequences following based on the introduction of the divorce by agreement in foreign country and China, then put forwards the countermeasures about how to perfecting the relevant legislation.
