对我国刑事被害人国家救助的再思考——以检察机关试点工作为视角

对刑事被害人给予经济上的救助是当前其最迫切的需求,当务之急是要建立刑事被害人经济救助制度,以填补立法空白。国家对刑事被害人实施经济救助对保护人权、提升政府公信力、追求正义价值等具有十分重大的价值功能,需要将该项工作尽快规范化、法律化。

It is the economic relief that current criminal victims most urgently and actually need. Therefore it is the urgent affair to establish an economic relief system for criminal victims so as to fill up the legislation gap. Our procuratorial organs have made beneficial exploration on relief to criminal victims in some areas and have got certain experience. The implementation of economic relief to criminal victims is of great importance to protect human rights, to enhance government credibility and to seek justice value. It is necessary to standardize and legislate for the national relief as soon as possible.
