摘要
美国斯坦福大学学生处分决定的作出需要交由校园陪审团通过准司法的听证程序,再分别听取校园司法调查官的起诉和被指控学生的答辩,经一系列法定程序方可成立。校园准司法制度不仅赋予了被指控学生十个方面的权利,也为其他诉讼参加人规定了七个方面的权利,且这些权利均以美国宪法性质的《权利法案》为立法基础,其不仅保障了被指控学生获得公正裁判的需要,也保障了其他普通学生的司法民主参与权,并且还在制度中蕴含了约束权力、保障人权、人民主权的宪政价值。
In Stanford University, the punishment of the student should be made by a series of legal procedures. The decision is made on the basis that the judicial panels hear the campus judicial officer's prosecution and the student's defense respectively through judicial heating procedures. The disciplinary student judicial system not only develops rights of ten aspects for the accused students, but also provides fights of seven aspects for other lawsuit participants in judicial proceedings. And the above tights are legally based on the American Constitution Bill of Rights.
