摘要
从国家理论的分析视角出发,援用委托-代理理论来说明我国农村土地产权的制度安排。农村土地产权代理制在长期的演化中逐渐形成,以隐蔽的形态存在,是国家与农村集体土地产权之间非正式契约下的委托-代理关系。在这样的委托-代理关系中,农村集体是产权主体,国家是产权代理主体。这种特殊的产权代理关系产生的社会基础是国家权力意志对农村土地产权的渗入,产权代理制形成机理在于产权形式的特殊和产权主体的弱势。由于产生环境和演进路径的特殊性,农村土地产权代理制有着区别于规范代理形式的特点。
From the viewpoint of the Government Theory, the rural land institution in China is analyzed by using the principal-agent principle. Rural land institution, which is an informal contract between the government and the rural collective, has been growing up in a long-term process in an inconspicuous way. Under this kind of mode, rural collective is the main body of property right, and government is main body of agent. The social basis of this institution is that government intervene rural land property right excessively, and the mechanism rest with particularity of rural land property right and puniness of famer's power. Due to special circumstance and path, there are characteristics different from other normal mode.
