现行劳动教养制度立法问题研究

On the Legislation Problem of Current Reform-through-Labor System

我国现行劳动教养制度立法中存在劳动教养的法律依据不充分,与其它法律制度和国际人权公约的矛盾与冲突,以及劳动教养法律规范缺乏统一性,执法存在随意性等问题。因此,有必要从立法上完善劳动教养制度。这是完善我国社会主义法律体系,实现依法治国的需要,是维护劳动教养人员合法权益的需要,是适应国际人权领域斗争的需要。

There are some problems in the current legislation of reform - through - labor system： lacking of sufficient legal basis, conflicting with other laws and stipulations of our country and the international human rights convention, lacking of unified laws and rules in this field, and enforcing the law at will. Therefore, it is necessary to improve the reform - through- labor system from the point of legislation. This is required to improve our socialism legal system, realize running the country according to law, protect the legal rights of legal workets, and fit in with the competition of international human rights.
