改革开放三十年我国新闻法律文化的变迁

Changes of Press Legal Culture in the 30 Years of China’s Reform and Opening-up

法律文化能够影响人们的法律选择、影响国家的法律制定,在法治建设中扮演重要角色。本文引入法律文化理论,探讨改革开放三十年我国新闻法律文化的变迁,总结出我国新闻法律文化的四个变化,即从政策文化走向法治文化、从义务本位走向权利本位、从群体精神走向人本精神和从秩序和谐走向全面和谐。法律文化的变迁折射出我国新闻法治建设的发展轨迹。

Legal culture can influence people＇s choice of law and the drafting of national laws, and it thus plays an important role in the construction of laws. Based on the theory of legal cultural studies, this article discusses the changes of press legal culture in the 30 years of China＇s reform and opening-up. It attempts to summarize four kinds of changes as follows： change from policy culture to legal culture; from obligation orientation to right orientation; from the group spirit to the individual spirit; and from the order harmony to the universal harmony. These changes appear to reflect the developing track of the construction of the press ruled by law in China.
