正义的本质内涵与当代宪法中的正义观

The Essential Connotation of Justice and the Viewpoint of Justice in Contemporary Constitution

正义是人对人类社会所作出的价值判断。实现正义一直被视为人类社会的美德和崇高理想。正义是评判人类社会制度的首要价值准则。要实现正义,最佳的途径是法治。因此,正义观在当代宪法的价值体系中占有不可取代的重要位置。在当代宪法的语境中,解读正义的要点在于:正义蕴涵着人的权利。正义蕴涵着人的行为规则。正义蕴涵着道德。市场经济本身不能形成正义,也不能派生出正义。因此,正义的实现必须依靠良好的制度设计与运作。

Justice, the value judgment of the human society, is regarded as the virtue and great ideality of the human society. So, justice was thought as the initial value rule of the htlman society system. The best way to achieve justice, is the nomocracy. The view of justice plays a very important role and is irreplaceable in the modem constitutional value system. In the idea of modem constitution, the point to understand the justice is： The justice contains human rights, the justice contains human behavior rules, and the justice contains morality. The justice can not be shaped by or derived from the market economy naturally, but it has to be achieved from the right system design and effective practice.
