摘要
当前我国矿产资源管理制度存在分级管理不能从根本解决地方政府与企业之间已经结成"利益同盟"的"内部人"和中央的宏观调控的"公用地灾难";矿产资源实际权限变动会造成下级政府预期的不稳定性,通过采用"加速开发,有水快流"的做法来获得即期利益,加大了中央调控矿业秩序的难度;矿产资源分类分级管理是矿产资源管理朝着理性化、制度化的方向发展的重要举措,要把它建立在法治的基础上,科学合理分类,确定责权的划分规则,并建立监督保障机制。
At present classifying management is implemented in the management system of mineral resources in China. But it can not solve the problem at all about interests distribution between central, local government and enterprises. This makes central control unsuccessful. The change of authority limits will cause unstable expectation of lower government and make the latter quicken the exploitation of mineral resources and gain immediate interests, it increase the degree of difficulty for central government to control and put mineral exploitation in order. The paper points out that implement classifying and grading management of mineral resources is a significant measure to improve the management of mineral resources. Then the paper puts forward some proposals to solve the problems, just like how to implement classifying and grading management etc.
