Affirming the Destructive Mining Method Concerning the Crime of Destructive Mining

破坏性采矿罪是我国1997年刑法新增设的罪名。破坏性开采方法的正确界定是准确认定破坏性采矿罪的关键。在认定破坏性开采方法时,我们不能仅以行为是否具有形式的"破坏性"来判断,不能机械地照搬刑法的规定,不能对最高人民法院《关于审理非法采矿、破坏性采矿刑事案件具体应用法律若干问题的解释》作形式的理解,必须按照绝大多数人认同的基本道理解释和运用法律,坚持实质的认定原则,否则会导致明显违情悖理的结果。

The crime of destructive mining is a new charge added in China's criminal law of 1997. Accurate delimitation of destructive mining method is the key point for defining the crime of destructive mining.The paper focuses on some specific issues that we should pay more attention to when we define the destructive mining method, these include: not merely because of the nominal'destructive'in the act; not mechanically copying the Penal Code, understanding ' Interpretation on Certain Issues Concerning Specific Application of Law for Trying Penal Case Relating to Illegal Mining and Destructive Mining' issued by the Supreme People's Court, is not a mere formality. The paper goes on to look at that we must interprete and apply the law according to the basic principles identified with the vast majority of people; adhere to the principle as to substance, otherwise, the result will be against human nature.
