论民办高校办学中的法律困境及其破解

Legal problems of non-governmental college running and its solution

民办高等教育是伴随着高等教育投资主体多元化而兴起的,已经成为我国高等教育的重要组成部分。但随着民办高等教育的发展,诸多法律困惑亦难以回避地凸现出来,如:民办高校的"法人"地位、民办高校的产权界定、民办高校的学生管理等问题,已经出现并制约了民办高等教育的发展。分析了产生上述问题的原因,提出了破解民办高校办学中法律困境的对策。

Under diversification of the principal parts of investment in higher education, non-governmental colleges were arisen. Up to now, non-governmental education has become one of the important parts of China＇ s higher education. However, with the development of non-governmental higher education, there are some legal problems that should be solved, such as the status of a non-governmental college as a＂juridical person＂, the division of property fights of non-governmental colleges, the management of the students in non-governmental colleges, and so on. These problems have affected the development of non-governmental education adversely. The paper analyzes the causes of the problems and proposes strategies to solve them.
