完善中国农民工社会保障制度的法律思考

Legal reflections on improving the social security system of China's migrant workers

为了解决在社会转型时期农民工这一特殊群体的社会保障问题,采取理论研究、实证研究等方法对中国农民工社会保障的立法现状及存在的问题进行分析,综合运用法学、社会学、政治学等理论进行研究,最终从提高立法位阶、完善立法体系、加强执法力度三个方面提出了关于中国农民工社会保障制度建立的相关立法建议。

To solve the social security issues of the special group of migrant workers in the period of social transition,the article uses theoretical and empirical methods to analyze the current legislation and problems of China＇s migrant workers＂ social security and uses the theories of law, sociology,politics to research the issue. Finally the authors propose relevant legislative suggestions on China＇s migrant workers＂ social security from three aspects： improving the legislative hierarchy, improving the legislative system and law enforcement.
