网络侵权案件地域性管辖权问题初探

网络空间的全球化和虚拟化使网络侵权案件的司法管辖界限变得模糊,也使得传统民事司法管辖的基础受到动摇和冲击。通过对网络侵权案件适用传统管辖规则的困境分析,提出网络侵权案件地域管辖应以当事人住所地作为一般管辖基础、在确定具体管辖法院时坚持"最密切联系"原则、确立一系列的指标以作为认定"最密切联系"的依据的网络侵权案件管辖体系模型的构想。

Globalization and virtualization of inter net makes jurisdiction over infringement case on internet obscure and has a great impact on the traditional foundation of civil legislation. Through analysis the difficulty of applying the traditional territorial jurisdiction over infringement case on internet, the author puts forward territorial jurisdiction over in- fringement case on internet should base on domicile of the party to the case, adhering to ＂the closes＇t relationship＂ principle when ascertaining the specific court, setting a series of index for identifying ＂the closest relationship＂.
