摘要
解除劳动合同的经济补偿是解除劳动合同时,用人单位和劳动者之间经常争议的问题。劳动法对应给予经济补偿的情形作了规定,但其规定尚不完善,在劳动争议处理过程中,产生了经济补偿具体适用的难题,对此应根据劳动合同解除的原因和情节。
Economic compensation for a termination of the labour contract can be often found as a disput between the employee and his enployer when the labour contract is terminated though there are regulations in the labour law used tonidicate under what conditions the compensation should be given.The regulations are not perfected. When in the dispute ,we can find that problems come in appropriate application of conpensation. In order to solve this problem we should perfect the conpensation regulations according to the reasons and degree of termination of labour content.
