乌鲁木齐市环境立法的现状分析和完善建议

Analysis and suggestions on current situation and perfection of environmental legislation in Urumqi

目的:针对乌鲁木齐市的环境状况,分析研究环境立法的现状、不足和现实需求,并提出相应的建议。方法:采用文献资料查阅、问卷调查、实地调研、数据分析等方法。结果:乌鲁木齐市的环境形势较为严重,比较突出的是大气污染问题。目前,乌鲁木齐市在控制环境污染方面的地方环境立法有较大发展,但仍存在诸多不足,有待进一步完善。结论:加强地方环境立法是改善环境质量、促进社会经济可持续发展的需要。本文就如何完善地方环境立法提出了注重法律条文的细化和可操作性、重视生态环境保护、强化责任追究和法律监督、完善公众参与等建议。

Objective： Based on the status of environmental quality in Urumqi, the status, actual demands and defects of environmental legislation were studied and analyzed. The suggestions about these problems were also put forward. Method： A series of ways such as survey on local residents,collecting materials and references, on-site research, data analysis were used and analysed. Results： The environment condition of Urumqi city was still serious especially air pollution in winter. Though the local environmental legislation on control of environment pollution in Urumqi had made great progress, there were still much room for further improvement. Conclusions： Strengthening local environmental legislation is a must for improving ecological environment and promoting the sustainable development of economy and society. A series of suggestions on perfecting local environmental legislation were put forward, which included attaching great importance to detailing articles of law and having general applicability of law, paying close attention to the protection of the ecological environment, strengthening accountability, legal supervision, and public participation.
