浅谈我国建筑工程施工索赔

随着建筑行业的管理规模逐渐扩大，在实施过程中，承包商因业主不履行或未能正确履行施工承包合同所规定的义务或未能保证施工承包合同条件实现而遭受损失后，可以向业主提出施工索赔。索赔是相互的、双向的。正确计算索赔金额，建立健全索赔制度，加强对工程索赔人员的培养，从而提高索赔效益。

With the gradual expansion of the management scale in the construction industry, the construction claims can be proposed towards owners if the contractor suffered losses from the owner who failed to properly perform its obligations under the contract or failed to achieve the construction contract conditions that are ensured in the implementation of construction contract. The claims are mutual and two-ways. So, to count the claim amount correctly, to build up sound claiming system and to strengthen the training of the claims-stuff are the effective ways to improve the efficiency of claims.
