论探望权主体制度缺陷及其完善

On Flaws of the Subject System of the Visitation Right and Improvement

我国2001年修改后《婚姻法》在探望权主体制度方面有着三个明显的立法缺陷:一是探望权主体范围过小,二是探望权主体范围过于模糊,三是探望权主体的规定违背立法宗旨,因而不利于家庭和社会的和谐,而亟待完善。在探讨探望权主体制度缺陷的基础上,提出了完善立法的建议:一是子女理应成为探望权的主体,二是各类父母对子女的探望权应予以完善,三是明确(外)祖父母的探望权主体地位,四是明确探望权行使的义务主体范围。

In 2001, China revised the ＂Marriage Law＂. But on the subject system of the visitation right it still has three obvious legislative flaws： limited and vague subject scope of the right, defiance of legislative intention, which will do no good to family and social harmony. Therefore, it needs to be improved. After discussion of the flaws of the subject system of the visitation right, a sound legislative proposal is put forward in this study.First, children should be the subject of the visitation right; Second, it should be improved that various types of parents should have the rights to visit their children; Third, it should be clear that grandparents should have the subject position of the visitation right; Fourth, the obligation subject scope of the visitation right should be defined.
