商标权与商号权冲突的比较法研究

A Comparative Study of the Conflict of Trademark Right and Trade Name Right

近年来,由于商标与商号内在易冲突的特性与国内相关立法与制度的缺失,造成商标权与商号权冲突的现象时有发生。本文对典型国家的相关立法进行比较,从各国解决冲突的主要思路入手,在解决冲突的具体原则、途径方面提出相关建议。

In the recent years, there have been some fight conflicts of trademark and trade name. This resuits from the inherent characteristics of trademark and trade name and the absence of related legislations and systems. Based on the comparative studies of the typical laws and legislations in some countries, this paper starts analyzing the main ideas of many countries in solving right conflicts and presents some suggestions con- cerning the specific principles and approaches.
