Modernization of the Rule of Law and Civil Ethics

公民伦理作为现代法治的伦理基础,在独立主体精神、权利与义务统一精神、契约精神、社会正义精神以及市俗伦理精神诸方面为法制现代化提供价值合理性和道德正当性的支持与引导。市场经济不成熟、民主宪政不足以及传统宗法伦理的消极影响严重制约我国公民伦理的发育,使得法制现代化深层乏力。实现法制现代化,须致力于培育公民社会,加强公民道德建设,以法治促进公民道德建设,实现公民道德和法治建设的良性互动。

Civil ethics, as the basis of the rule of law, provides value rationality, the support of moral legitimacy and guidance for the modernization of the rule of law in terms of independence, the unity of right and duty, contract spirit, social justice and civil ethics. However, in China＇ s modernization process, there exist some obstacles such as immature market economy, inadequate constitutional democracy as well as negative impacts of traditional and patriarchal ethics. To realize the modernization of the rule of law, it is important to cultivate a civil society and strengthen civil ethics. Meanwhile, the rule of law should serve the cultivation of civil ethics in order to realize the positive interaction between the rule of law and civil ethics.
