Protect traditional knowledge through the intellectual property law

对传统知识的关注始于二十世纪五十年代,国际组织以及各相关国家基于不同的理念以及利益考量,在传统知识的保护方面进行了各具特色的探索,积累了丰富的经验,如今,是否将传统知识纳入知识产权法的框架,是理论界争论的焦点。本文从"马太效应"体现出的经济原理,私法的价值理念以及洛克的劳动财产理论出发,论述以知识产权法来调整和保护传统知识的正当性,试图为传统知识搭建一座通往知识产权法的桥梁。

Attentions toward traditional knowledge started at the 50s of last century. International organizations and many countries have explored various ways on how to protect traditional knowledge based on different conceptions and interests. Now, the key point of traditional knowledge is whether to put it into the intellectual property law. The main idea of this article is related to the validity of adjusting traditional knowledge through the intellectual property law.
