论我国地方立法的无效供给问题及其对策——以烟花爆竹禁放改限放为视角

The problem of invalid supply and its countermeasure in China's local legislative quality,——with a case study of the policy revision from banning to circumscription in setting off fireworks and firecrackers

众所周知,在全国几百个城市实行的禁止燃放烟花爆竹的地方立法,在实施了十多年后又都不约而同纷纷变"禁止燃放"为"限制燃放"。曾经付出的高昂法律成本理应得到人们长久的思考.以烟花爆竹在各地禁放改限放的制度变迁这一典型案例为视角,有利于我们对全面系统分析我国地方立法现存的无效供给问题,而解决这些问题的对策之一,就是建立地方立法质量评估制度。

It is commonly known that the local legislation of the banning of setting off fireworks and firecrackers in hundreds of Chinese cities changed from banning to circumscription in one city from another after over ten years implementation. The high price once paid deserves people＇ s long consideration. The policy changing in this typical case reflects the invalid supply in China＇ s local legislation. One countermeasure is to estabhsh the evaluation system of local legislative quality.
