试论海峡两岸农业交流与合作中的若干法律问题

On the Legal Issues on Agricultural Exchange and Cooperation between the Mainland and Taiwan Island

目前,在两岸农业交流与合作取得丰硕成果的同时,相关法律问题也日益彰显,这些问题包括涉台农业行政纠纷、农业知识产权纠纷,以及台商在大陆从事农业经营与贸易的其他相关法律问题。欲解决这些问题,首先应该在立法上形成一套偏重于地方立法的法律规范体系,其次是建立涉台农业知识产权保护机制,再次是健全涉台行政执法,完善其他相关法律配套措施,等等。

At present, the relevant legal issues become gradually obvious, with the development of agricultural exchange and cooperation between the mainland and Taiwan Island, including the agrieuhure administration disputes, agriculture intellectual property rights disputes, and so on. The author thinks, in order to resolve these issues, firstly, we ought to build a set of legal norm system inclined to the local regulation; secondly, perfect the protection mechanism of agriculture intellectual property rights relevant to Taiwan, and then, strictly enforce the administration law relate to Taiwan Residents, perfect relevant law supporting measures, etc.
