摘要
人事诉讼纠纷涉及婚姻家庭的和谐稳定,具有较强的公益性,大陆法系国家普遍确立了人事诉讼程序来解决人事纠纷,以示国家之重视,而我国尚未确立一项专门解决人事纠纷的诉讼机制和程序。随着我国司法改革的发展,越来越多的学者认为我国应适应这一趋势,构建我国人事诉讼程序。而笔者不以为然,认为我国在原有的制度基础上加以完善即可达到与建立新的人事诉讼程序同样的效果。
Personnel disputes involve the harmony and stability of a marriage and a family, and possess a strong public welfare. Continental law system countries have generally established personnel action proceedings to solve the personnel disputes, showing the country' s attention to it. But in China, a mechanism and procedure to solve the personnel disputes has not set up specifically. With the development of China' s judicial reform, more and more scholars consider China should set up its personnel action proceedings to suit the situation. The author considers China would solve the personnel disputes by improving the original proceedings on base of its former system rather than to establish a new personnel action proceeding.
