论中国审前羁押制度的修正

On the Reform of Pretrial Detaining System in China

审前羁押制度是刑事诉讼过程中保障诉讼顺利进行的一种非常重要的强制措施,虽然我国强制措施体系中并未确立与之直接对应的措施,但有中国特色的拘留与逮捕在某种意义上被认为就是中国的审前羁押制度。在分析审前羁押制度的基础理论之后,提出了修正中国审前羁押制度的思想。

Pretrial detaining system, which could help the suit go smooth, is one of the important compulsory measures in the criminal procedure. In our country, there is no the same measure, but in some sence, detention and arrestment am viewed as the pretrial detaining system in China. After the analysis on the fundamental theory of this system, the author puts forwards the thoughts of modifying our existing pretrial detaining system.
