On property rights alteration under Anglo-American law system

在对英美法系物权变动模式进行类型化论述的基础上,比较分析契据移转与物权行为理论。提出英美法中的契据交付作为一种单方行为具有独立性和无因性,但由于英美法系特有的普通法与衡平法二元法律体系,使得英美法系的不动产物权变动表现出既有意思主义的一面又有形式主义的一面的特征。

Based on the typological elaboration on the real right alteration patterns in Anglo-American law system, the paper analyzed the theories of transfer of deed and juristic act of real right comparatively, and proposed that transfer of deed is a unilateral act under Anglo-American law system with the validity of property right transfer and quality of being independent and abstract, which is similar to real right formalism, however, the credibility of registration which is a feature of formalism is mitigated by the duel system of common law and equity in AngloAmerican law system.
