摘要
每个共同共有关系存续期间和尚未分割共有财产时,都不能处分共有财产或转让自己的权利。随着市场经济的迅猛发展,这一原则对尊重契约、鼓励合法交易的市场要求必然产生阻碍,不利于市场的发展。现实社会中,因共有房屋转让引发的纠纷比较突出,因而对转让共有房屋的效力进行分析,就显得非常必要。
According to prensent chinese laws,propenies can't be privately disposed when they are owed by several people and not divided.At the same time, they are not allowwed to transfer to other people.With the booming of market economy, this phnciple is necessarily harmful to us, because it hinders the development of market where contracts are observed,legal deals are encouraged. In reality, disputes of. transfening houses are often be seen,so it is very imponant for us to analyze how to deal with these troubles.
