论同性伴侣婚姻家庭权利的保护

On the Protection to Same-sex Couples Right of Marriage and Family

传统观念认为婚姻是一男一女的结合,而同性恋者的性活动或性吸引力则指向同性的人群,所以同性伴侣就被排除在了婚姻法的保护范围之外。虽然就社会整体而言,同性恋群体是一个相对隐蔽的少数群体,但是同性伴侣的权益保护问题还是应当引起社会的重视,引起法律的关注。即使在我国当前从婚姻法上确认同性伴侣合法配偶身份的时机还不成熟,但我们还是应当鼓励和引导同性伴侣通过订立合同等其他方式保护自己的婚姻家庭权利。

Traditional concept of marriage is that of a man and a woman, and homosexual sexual activity or sexual attraction at the same crowd, same-sex couples were excluded from the scope of protection of the law. Mthough the community as a whole, the homosexual groups is a relatively hidden minorities, but to protect the fights of same-sex couples should lead to social problems or attention, give rise to legal concerns. Even from the law on same-sex couples legally recognized spouse as the time was not ripe, we should encourage and guide couples through the conclusion of the contract, and other ways to protect their marriage and family interests.
