民间法与国家法的关系——兼论乡村社会法治秩序的建构

Relation of Folk Law and National Law

在"政府推进型"的法治道路上,我们往往忽视另外一套在乡村社会发挥调控、规制作用的规范----民间法。而民间法的存在已是不争的事实。通过论述国家法与民间法的四种关系情形,认为民间法与国家法共同构建着乡村社会的法治秩序。乡村社会法治秩序建构的关键应当是实现民间法与国家法的良性互动。

The rule of law on the road of 'Government-forward',we tend to overlook the other in a rural society--civil law,play a regulation to regulate the production.Civil law and common law countries to build rural social order and the rule of law on relations of national law and civil law.Realization of civil law and national law of positive interaction is the key of Construction of rural social order and the rule of law.
