环境权是自然人享有适宜自身生存和发展的良好生态环境的法律权利。其主体限于自然人;其客体是环境生态功能;其内容是指向环境生态功能这一特定客体的利益群;其权能包括对良好生态功能的保有权、享受权等实体性权能和环境参与权、环境知情权、环境请求权等程序性权能,其中,环境参与权是核心权能。
