职场性骚扰雇主责任归责原则研究 被引量:5

摘要 职场性骚扰雇主责任依据骚扰类型实行不同的归责原则:一是对于监督管理者雇员实施的交换型性骚扰雇主承担严格责任,即典型的雇主替代责任;二是对于敌意环境型性骚扰雇主承担过错责任。更恰切的说是过错责任中的推定过错责任,即若雇主对防止和纠正性骚扰行为已尽到谨慎注意提出合理抗辩就不再承担责任,否则雇主就要为其过错承担责任。这属于雇主的自己责任,而不是替代责任。
