摘要
企业改制既是产权性质和组织形式的变革,又是我国劳动关系的一场重大变革。它使我国劳动关系从计划走向市场,从行政化走向契约化,从一元化走向多元化。企业改制已成为影响我国劳动法律关系的重大法律事实。既要保证企业改制的程序公正,又要将企业改制引起的劳动争议纳入司法解决的轨道,才能使劳动者的劳动权益不被侵犯。
Strypped-down of enterprises is not only the reformation of property and organization, but also important reformation of laboural relations of our country. The labour relations of our country has been changed by strypped-down of enterprises from planned economy to marked economy, from administrative relation to contractual relation, from silplify to multi-ply. Strypped-down of enterprises has been important negotia juris of labour relations of our country. We must bring the disputes aroused by strypped-down of enterprises into jurisdictional procedure and ensure equity of procedure in strypped-down of enterprises. So the labour rights can not been trenched.
