完善我国格式合同法律制度的思考

On the Thoughts about Improving the Legal System of Format Contract

格式合同在给现代社会带来效率和便利的同时,也在日益威胁着社会的公平与正义。因此,各国立法都对之加以严格规制。本文从格式合同的概念和特征出发,阐述了立法规制格式合同的必要性,指出我国格式合同法律制度存在的不足,并提出了相应的完善建议。

Format contract not only brings the efficiency and convenience to the modern society, but also threatens the social fairness and justice increasingly. Therefore, legislation in different countries regulates it strictly. This paper elaborates the necessity of format contract regulated by legislation from the perspective of the concept and characteristic of format contract, points out the shortcomings of the legal system of format contract in China, and also proposes some suggestions of improvement correspondingly.
