On the Representation of State-owned Assets Ownership and Authorized Exercising

国有资产所有权的代表与授权行使是我国国有资产法立法的核心内容之一,其关键问题在于"代表"与"授权"所具有的法律意义。国有资产所有权代表和授权行使的法律架构应为:国务院及地方政府代表国家行使国家所有权即对国家出资企业的出资人权利;国务院国有资产监督管理机构和地方人民政府按照国务院规定设立的国有资监督管理机构依法代表本级政府对国家出资企业行使出资人权利。

The representation and authored exercising of state-owned assets ownership is the core content of the Law of State-owned Assets in China. The key issue lies in the legal significance of “representation” and “authorization”. This article first compares the legal significance of “representation” and authorization and then further analyzes the legal framework currently being constructed in China. Finally the relevant proposals for per- fection and improvement are put forward in order to provide theoretical support for the legislation of the Law of State-owned Assets.
