从《欧盟数据库指令》谈中国数据库立法设想 被引量：4

摘要 对数据库的法律保护模式进行了分析,讨论了现行版权法和反不正当竞争法在保护数据库方面的不足和缺陷。借鉴欧盟1996年的《数据库保护指令》的内容,建议在版权法的体系之外,由国务院制定专门的《数据库保护条例》,同时探讨了其立法框架及相关问题。
