监狱功能与基本权利保障——兼论中国监狱的改革

Function of Jail and Protection of Fundamental Rights

基于对囚犯基本权利保障之认识,中国近代监狱改良者和西方自然法学派都认为监狱对囚犯的功能必须由人身罚向自由罚转变。联合国的相关规则和公约为监狱对囚犯基本权利的保障功能提供了规范基础。中国监狱改革要在不违反国际人权公约相关规范的前提下,结合中国国情,走一条中国特色的监狱管理和改革之路。

Aware of the protection of prisoners' fundamental rights,both China's modern jail reformers and western scholars of natural law think that the function of jail must turn from the personal punishment to freedom punishment.The relevant convention and rules of the United Nations offer a series of norms to protect prisioners' fundamental rights.The reform of China's jail should comply with the International Convention of Human Rights and be furthered on the basis of its own charateristic situation.
