On the principle of strict liability of torts——Taking legal economics analysis as the starting point

现代意义上的侵权法严格责任,是作为相对于过错责任的责任规则产生并发展起来的,但它不是过错责任的简单轮回,而是更高一级的责任。本文试图采取法律经济学的视角,分析严格责任的产生和发展,并从经济学的角度分析其在不同情况下的利弊,以期找出最佳的适用条件和范围,实现社会成本的最小化。

Relative to fault liability doctrine, modem strict liability of torts brings about and develops, which isnt a simple reincarna- tion of fault liability, but a higher level responsibility. This article attempts to analyze the emergence and development of strict liability from the perspective of law-economics, and analyzes pros and cons in different circumstances from economic viewpoint, hoping to find the best applicable conditions and scopes and to achieve the minimum of social costs.
