传统司法制度价值的一点反思

Reflection on the Value of Traditional Judicial System

中国的司法改革是一项涉及诸多复杂问题的社会系统工程。中国的司法改革应该把司法制度自身的变革和外部社会环境的培育和改造两方面结合起来。在变革现有司法制度的时候,一方面要充分移植和吸收西方先进的司法制度和理念,同时不应忽视本民族的传统司法制度。中国传统司法制度在当今的司法改革中有以下价值:认同、互补、借鉴和反思。

China＇ s judicial reform is a tough social project involving lots of complicated problems. Based on the reflections and analysis of Mr. He Wei-fang＇ s speech about China＇ s traditional judicial system, this paper suggests a combination of judicial system reform and the cultivation of external social environment. Judicial reform should fully absorb and assimilate advanced western judicial systems and concepts, but on the other hand should not neglect our traditional judicial system. This paper further puts forward the value of China＇ s traditional judicial system on the current judicial reform at the following four aspects： self-identification, complement, reference and reflections
