取消受贿罪中“为他人谋取利益”要件对司法实践的影响

Influence of the Concealment of "Try to Obtain Advantages for Others" in Bribery Crime

笔者在《受贿罪中"为他人谋取利益"要件取消论》一文中曾提出受贿罪客体是国家工作人员的廉洁性及公众对廉洁性的信赖的观点,据此得出,"为他人谋取利益"作为受贿罪必备要件的取消是受贿罪客体的必然要求。取消这一要件将会增强法条的可操作性、明确受贿罪既遂与未遂的区分标准,而且不会产生有些学者所顾虑的与馈赠、诈骗行为无法区分的消极影响。

In the article of The Concealment of ＂Try to Obtain Advantages for Other＂ s in Bribery Crime, the author has brought up an idea that the essence of bribery is national staff＇s incorruptibility and people＇s trust. On this ba- sis, the author concluded that the concealment of ＂trying to obtain advantages for others＂ in bribery crime is necessa- ry frors the essence of bribery crime angle. It will enhance the operability; also, it will make the distinction of accom- plished and attempted clearer. Meanwhile, the concealment will not produce negative impact on the distinction between bribery and present, bribery and fraud.
