结合近年来我国竞技体育领域内因运动员人力资本产权问题而频繁出现的种种纠纷,运用产权经济学相关理论,从人力资本产权权能界定的现实意义、人力资本产权的所有权、使用权、收益权和处置权的界定等方面,就我国竞技体育运动员人力资本产权二元属性的特殊情况进行了研究。

Against the background that recently various disputes have appeared in our athletic sports arena due to athletic human capital property rights, this article, by employing relevant theories of property rights economics, researches the duality attribute of our athletic human capital property rights from such aspects as the practical significance of the designation of human capital property rights, and the designation of the ownership, access, usufruct and disposition of human capital property rights.
